evitar alg\u00fan da\u00f1o inminente al medio ambiente y la salud de las personas, el Primer Tribunal Ambiental decidi\u00f3 aplicar la medida provisional pre procedimental de suspensi\u00f3n de funcionamiento por 15 d\u00edas del lamaducto, ubicado en la Quebrada Variante del Proyecto Minero Caserones, de la empresa SCM Lumina Copper Chile S.A. que sufri\u00f3 una rotura y origin\u00f3 el derrame de relaves el 20 de marzo del 2018.<\/p>\n<p>La resoluci\u00f3n dictada con fecha 29 de marzo corresponde a la causa S-8-2018 y busca cautelar especialmente la salud de las personas ya que el derrame de concentrado afect\u00f3 las aguas del r\u00edo Ramadillas, afluente utilizado para el consumo humano de la poblaci\u00f3n vecina al proyecto minero que se encuentra ubicado a 162 kil\u00f3metros al sureste de Copiap\u00f3, a una altura maxima de 4.600 m.s.n.m.<\/p>\n<p>El lamaducto, o ducto de conducci\u00f3n de relaves finos, se caracteriza por tener una elevada presencia de sulfatos y conductividad el\u00e9ctrica, adem\u00e1s de bajos niveles de pH y una importante existencia de metales pesados, a lo que se debe sumar un alto potencial de generaci\u00f3n de acidez, todo lo cual contribuye a producir alteraci\u00f3n en las condiciones normales de calidad de las aguas que son utilizadas para el consumo humano.<\/p>\n<p>Adem\u00e1s, los impactos afectar\u00edan tambi\u00e9n al componente suelo, ya que el material minero escurri\u00f3 por un camino que est\u00e1 ubicado a un costado del lamaducto afectando una superficie de 0,49 hect\u00e1reas aproximadamente.<\/p>\n<p>Finalmente, el informe entregado por la SMA indica que la solicitud de la medida se sustenta en la potencial fuente de riesgo que representa el lamaducto, ya que no s\u00f3lo presenta un importante grado de desgaste, sino tambi\u00e9n por la falta de mantenci\u00f3n de la obra de captaci\u00f3n a los pies de la Quebrada Variante 2, la que se ha mostrado ineficaz para contener los derrames de las lamas y ha permitido el escurrimiento de ellas hacia el cauce del r\u00edo
