{"id":21316,"date":"2023-01-21T12:53:12","date_gmt":"2023-01-21T15:53:12","guid":{"rendered":"https:\/\/www.1ta.cl\/?p=21316"},"modified":"2026-03-08T20:59:45","modified_gmt":"2026-03-08T20:59:45","slug":"reclamaciones-por-decreto-que-establece-como-humedal-urbano-la-desembocadura-del-rio-elqui-quedaron-en-estudio","status":"publish","type":"post","link":"https:\/\/1ta.cl\/1\/reclamaciones-por-decreto-que-establece-como-humedal-urbano-la-desembocadura-del-rio-elqui-quedaron-en-estudio\/","title":{"rendered":"Reclamaciones por decreto que establece como humedal urbano la desembocadura del R\u00edo Elqui quedaron en estudio"},"content":{"rendered":"<ul>\n<li><strong><em>La determinaci\u00f3n del Primer Tribunal Ambiental tiene como fin recabar mayores antecedentes de la causa y la realizaci\u00f3n de una visita inspectiva a la zona.<\/em><\/strong><\/li>\n<\/ul>\n<p>En agosto del a\u00f1o pasado el Ministerio de Medio Ambiente (MMA) reconoci\u00f3 al humedal de la desembocadura del R\u00edo Elqui como el primer humedal urbano de la Regi\u00f3n de Coquimbo. Dicha determinaci\u00f3n trajo consigo la interposici\u00f3n de seis reclamaciones ante el Primer Tribunal Ambiental con el fin de revertir la decisi\u00f3n del ministerio.<\/p>\n<p>Actualmente, las causas que, han sido presentadas por due\u00f1os de predios y empresas inmobiliarias, est\u00e1n en distintas etapas tanto en el \u00f3rgano jurisdiccional como en el Tribunal Constitucional. Todas alegan que se afecta el derecho de propiedad ya que la superficie que abarca el declarado humedal urbano -a juicio de los reclamantes- se superpone a sus predios.<\/p>\n<p>En los \u00faltimos d\u00edas, el \u00f3rgano jurisdiccional escuch\u00f3 los alegatos de dos causas presentadas por inmobiliarias, caratuladas como R-75-2022 y R-76-2022, y determin\u00f3 dejarlas en estudio para recabar m\u00e1s antecedentes y para la realizaci\u00f3n de una visita inspectiva de los ministros a la zona, la que se efectuar\u00e1 el pr\u00f3ximo mi\u00e9rcoles 25 de enero.<\/p>\n<p>La decisi\u00f3n fue tomada por la ministra presidenta Sandra \u00c1lvarez Torres y los ministros Mauricio Oviedo y Carlos Valdovinos. En dicha visita se recorrer\u00e1n diversos sectores que dicen relaci\u00f3n con las causas, as\u00ed como la zona de influencia del humedal.<\/p>\n<p><em><strong>Audiencias<\/strong><\/em><br \/>\nEn las audiencias de las dos causas, los abogados reclamantes centraron sus alegatos en lo que es la afectaci\u00f3n al derecho de propiedad y el no cumplimiento de los criterios que establece la Gu\u00eda de Delimitaci\u00f3n Humedales, sino que criterios que est\u00e1n m\u00e1s all\u00e1 de la Ley.<\/p>\n<p><em><strong>Ministerio del Medio Ambiente<\/strong><\/em><br \/>\nA trav\u00e9s de la Resoluci\u00f3n Exenta N\u00b0833 del Ministerio de Medio Ambiente se reconoci\u00f3 el Humedal Urbano R\u00edo Elqui, Altovalsol a Desembocadura y se determin\u00f3 su superficie en 492,8 hect\u00e1reas que van desde la localidad de Altovalsol hasta la desembocadura del R\u00edo Elqui.<\/p>\n<p>De acuerdo con lo estipulado por el Ministerio del Medio Ambiente, la Ley N\u00b021.202 conocida como Ley de Humedales Urbanos \u201cbusca proteger ecosistemas reconociendo el rol de estos para la conservaci\u00f3n de la biodiversidad y la provisi\u00f3n de servicios ecosist\u00e9micos claves para mejorar la calidad de vida de las personas\u201d.<\/p>\n<p>Revisa las causas ac\u00e1:<br \/>\nhttps:\/\/causas.1ta.cl\/causes\/314\/expedient\/7555\/books\/265\/?attachmentId=13118<br \/>\n<a href=\"https:\/\/causas.1ta.cl\/causes\/316\/expedient\/7560\/books\/267\/?attachmentId=13128\">https:\/\/causas.1ta.cl\/causes\/316\/expedient\/7560\/books\/267\/?attachmentId=13128<\/a><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La causa fue presentada por la empresa luego de que el Servicio de Evaluaci\u00f3n Ambiental (SEA) no diera el visto bueno para la ejecuci\u00f3n de la iniciativa que pretende desarrollarse en el Salar de Atacama, Regi\u00f3n de Antofagasta.<\/p>\n","protected":false},"author":1,"featured_media":21317,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"nf_dc_page":"","_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[60],"tags":[],"class_list":["post-21316","post","type-post","status-publish","format-standard","has-post-thumbnail","category-noticias-del-primer-tribunal-ambiental"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.8 -
