{"id":23303,"date":"2023-10-05T12:38:27","date_gmt":"2023-10-05T15:38:27","guid":{"rendered":"https:\/\/www.1ta.cl\/?p=23303"},"modified":"2023-10-05T12:38:27","modified_gmt":"2023-10-05T15:38:27","slug":"construcciones-copiapo-s-a-reclama-ante-el-primer-tribunal-ambiental-por-la-no-aprobacion-de-su-programa-de-cumplimiento","status":"publish","type":"post","link":"https:\/\/1ta.cl\/1\/construcciones-copiapo-s-a-reclama-ante-el-primer-tribunal-ambiental-por-la-no-aprobacion-de-su-programa-de-cumplimiento\/","title":{"rendered":"Construcciones Copiap\u00f3 S.A. reclama ante el Primer Tribunal Ambiental por la no aprobaci\u00f3n de su Programa de Cumplimiento"},"content":{"rendered":"<p>Una reclamaci\u00f3n contra la Superintendencia del Medio Ambiente (SMA) realiz\u00f3 la empresa Construcciones Copiap\u00f3 S.A. ante el Primer Tribunal Ambiental debido al rechazo del Programa de Cumplimiento (PdC) presentado para superar denuncias por ruidos molestos debido a las obras que lleva a cabo en la calle Borgo\u00f1o de la ciudad.<\/p>\n<p>La causa, caratulada como R-96-2023, fue admitida a tr\u00e1mite por el tribunal por lo que ya se solicitaron los informes correspondientes a la SMA.<\/p>\n<p>Respecto a los antecedentes de la reclamaci\u00f3n, la constructora se\u00f1ala en su escrito que el organismo fiscalizador rechaz\u00f3 el Programa de Cumplimiento que conten\u00eda diversas acciones para poder cumplir con lo que le fue exigido luego de la denuncia en su contra por ruidos molestos.<\/p>\n<p>La constructora, que fue sancionada por la superaci\u00f3n de la norma, asegura haber presentado diversas medidas para mitigar los ruidos de las obras que ejecuta, entre ellas un cierre perimetral, biombos ac\u00fasticos, dispositivos para sellar ventanas, puertas y agujeros cuando se trabaja al interior de la edificaci\u00f3n y la implementaci\u00f3n de un Manual de Buenas Pr\u00e1cticas para el relacionamiento comunitario de la C\u00e1mara Chilena de la Construcci\u00f3n con el objetivo de facilitar el trabajo y fluidez con los vecinos y vecinas del proyecto.<\/p>\n<p>No obstante lo anterior, en el escrito ingresado por la empresa, se explica que de todas formas la SMA realiz\u00f3 un procedimiento sancionatorio y levantamiento de cargos, ante lo cual presentaron un PdC que no fue aceptado por el organismo, as\u00ed como tampoco nuevas medidas propuestas.<\/p>\n<p>\u201c(La empresa) no solo cumpli\u00f3 con todas las acciones, sino que, adem\u00e1s, present\u00f3 un PdC reforzado adjuntado al recurso de reposici\u00f3n rechazado, donde voluntariamente y de buena fe, ofreci\u00f3 y adopt\u00f3 medidas acogiendo las observaciones planteadas por la SMA\u201d, estipula el documento.<\/p>\n<p>La constructora solicita que se apruebe el PdC presentado ya que asegura que las medidas adoptadas son id\u00f3neas ya que nuevas mediciones han arrojado resultados que se ajustan a la normativa.<\/p>\n<p>Causa R-96-2023\u00a0<a href=\"https:\/\/www.portaljudicial1ta.cl\/sgc-web\/ver-causa.html?rol=R-96-2023\">https:\/\/www.portaljudicial1ta.cl\/sgc-web\/ver-causa.html?rol=R-96-2023<\/a><\/p>\n<p><em>*(Imagen referencial)<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La causa, caratulada como R-96-2023, fue admitida a tr\u00e1mite por el tribunal por lo que ya se solicitaron los informes correspondientes a la SMA.<\/p>\n","protected":false},"author":1,"featured_media":23304,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"nf_dc_page":"","_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[60],"tags":[],"class_list":["post-23303","post","type-post","status-publish","format-standard","has-post-thumbnail","category-noticias-del-primer-tribunal-ambiental"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.8 -
