Corte Suprema dict\u00f3 sentencia en la causa <strong>Rol N\u00b0 147.155-2023<\/strong>, vinculada a la causa ventilada ante el Primer Tribunal Ambiental, <strong>Rol D-11-2021<\/strong>, caratulado \u201cCarlos Fabi\u00e1n Herrera Toledo con Max Andr\u00e9s Didier Vald\u00e9s\u201d, declarando inadmisibles los recursos de casaci\u00f3n en la forma y en el fondo interpuestos por el demandado en contra de la sentencia dictada por ese Tribunal el 2 de junio de 2023.<\/p>\n<p>El m\u00e1ximo tribunal estim\u00f3 que los recursos interpuestos no pod\u00edan prosperar, porque la decisi\u00f3n impugnada por las v\u00edas de la nulidad formal y sustancial, esto es, las medidas cautelares decretadas por el Primer Tribunal Ambiental, no presentan las caracter\u00edsticas que exigen los art\u00edculos 766 y 767 del C\u00f3digo de Procedimiento Civil \u201ctoda vez que no se trata de una sentencia definitiva ni interlocutoria que ponga t\u00e9rmino al juicio o haga imposible su continuaci\u00f3n, ni de una dictada en segunda instancia que adolezca de los defectos en aludidos precedentemente, raz\u00f3n por la cual los recursos de nulidad intentados en autos no podr\u00e1n prosperar. [\u2026]\u201d.
