{"id":24337,"date":"2024-05-31T12:09:56","date_gmt":"2024-05-31T15:09:56","guid":{"rendered":"https:\/\/www.1ta.cl\/?p=24337"},"modified":"2024-05-31T12:09:56","modified_gmt":"2024-05-31T15:09:56","slug":"primer-tribunal-ambiental-audiencia-r-102-2024","status":"publish","type":"post","link":"https:\/\/1ta.cl\/1\/primer-tribunal-ambiental-audiencia-r-102-2024\/","title":{"rendered":"Primer Tribunal Ambiental escuch\u00f3 los alegatos en reclamaci\u00f3n contra autorizaci\u00f3n dada a Proyecto \u201cAjustes Constructivos de Relaves Espesados\u201d de CODELCO, Divisi\u00f3n Radomiro Tomic"},"content":{"rendered":"<div id=\"attachment_24338\" style=\"width: 4010px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" aria-describedby=\"caption-attachment-24338\" loading=\"lazy\" class=\"wp-image-24338 size-full\" src=\"https:\/\/ukr.ivk.mybluehost.me\/website_11c5fef7\/wp-content\/uploads\/IMG_5628-copia.jpg\" alt=\"\" width=\"4000\" height=\"1866\" \/><p id=\"caption-attachment-24338\" class=\"wp-caption-text\">Audiencia Causa R-102-2024<\/p><\/div>\n<p>&nbsp;<\/p>\n<p>Este mi\u00e9rcoles 29 de mayo, en causa Rol R-102-2024, fueron escuchadas las alegaciones de las partes, adem\u00e1s del tercero coadyuvante, este es, Codelco, Divisi\u00f3n Radomiro Tomic, titular del Proyecto \u201cAjustes Constructivos de Relaves Espesados\u201d.<\/p>\n<p>La reclamaci\u00f3n fue interpuesta por la Asociaci\u00f3n Ind\u00edgena de Agricultores y Regantes de Chiu-Chiu (ASACHI), que busca se deje sin efecto la Declaraci\u00f3n de Impacto Ambiental favorable al proyecto ya referido, esencialmente por no haber sido incluidos en las reuniones que dispone la ley con grupos humanos ind\u00edgenas (Art. 86 del Reglamento del Sistema de Evaluaci\u00f3n Ambiental), entender adem\u00e1s que habr\u00eda infracci\u00f3n al deber de consulta ind\u00edgena contenido en el Convenio 169 OIT y no haberse considerado en el proyecto los impactos acumulativos del actual proyecto con el proyecto anterior denominado \u201cRT Sulfuros\u201d del mismo titular.<\/p>\n<p>En este contexto, el abogado Christi\u00e1n Rojas Calder\u00f3n por los reclamantes entre otros aspectos en su alegato expuso que la ASACHI es una asociaci\u00f3n ind\u00edgena as\u00ed reconocida por la CONADI con integrantes pertenecientes tanto al pueblo Aymar\u00e1 como Atacame\u00f1o, que est\u00e1 adem\u00e1s en \u00e1reas de desarrollo ind\u00edgena, dedicada en lo principal a la actividad agr\u00edcola en el valle del Loa. Agreg\u00f3 en este sentido que no haber hecho una consulta ind\u00edgena resulta ser una violaci\u00f3n flagrante al art\u00edculo 7\u00b0 del Reglamento del Sistema de Evaluaci\u00f3n Ambiental (RSEIA). Hizo adem\u00e1s presente que el defecto de no tomar en cuenta el efecto acumulativo de este proyecto al anteriormente aprobado, se deber\u00eda a que el actual proyecto aprobado por el Servicio de Evaluaci\u00f3n Ambiental (SEA), ha sido objeto de ocho modificaciones, bajo la modalidad de declaraciones, sin tener entonces elementos para evaluar el eventual efecto acumulativo que se reclama.<\/p>\n<p>A su vez la abogada Rosario Quiroz Barra, representando al Servicio de Evaluaci\u00f3n Ambiental, hizo presente que el proyecto en cuesti\u00f3n, es de car\u00e1cter menor, en tanto s\u00f3lo consistir en una modificaci\u00f3n constructiva, que no implica nuevas obras o nuevos caminos. Tambi\u00e9n afirm\u00f3 la experticia del SEA para evaluar proyectos en la zona en tanto haber ejecutado esta tarea en m\u00e1s de cien proyectos en el sector. Aclar\u00f3 que el SEA no hizo una consulta ind\u00edgena en tanto, no existir\u00eda una afectaci\u00f3n directa a un pueblo ind\u00edgena, siendo el m\u00e1s cercano de acuerdo a la caracterizaci\u00f3n de grupos humanos pertenecientes a pueblos ind\u00edgenas (GHPPI), la comunidad atacame\u00f1a de San Francisco de Chiu Chiu (a 7,5 kms.), aclarando que en la zona de influencia del proyecto no hay ocupaci\u00f3n efectiva.<\/p>\n<p>Finalmente, el abogado Rodrigo Guzm\u00e1n Rosen, en representaci\u00f3n de CODELCO, hizo presente que la reclamaci\u00f3n interpuesta por ASACHI, adolec\u00eda de deficiencias estructurales, en tanto ser infundada, abstracta y especulativa. En particular ser\u00eda infundada al no existir correlaci\u00f3n con la resoluci\u00f3n reclamada en sede judicial, sino que es una copia del recurso planteado en sede administrativa, lo que a su parecer implica que no logra desvirtuarse el principio de legalidad contenido en el art\u00edculo 3\u00b0 de la ley N\u00b0 19.880, tomando entonces cuerpo el principio de conservaci\u00f3n del acto administrativo. Recalca adem\u00e1s que ASACHI tuvo la oportunidad de participar en la evaluaci\u00f3n de este proyecto, distinguiendo entre las f\u00f3rmulas de participaci\u00f3n ciudadana de las reuniones contempladas en el art\u00edculo 86 del RSEIA, permitiendo ambos instrumentos entregar informaci\u00f3n por parte de los interesados.
