{"id":24363,"date":"2024-06-11T09:59:31","date_gmt":"2024-06-11T12:59:31","guid":{"rendered":"https:\/\/www.1ta.cl\/?p=24363"},"modified":"2024-06-11T09:59:31","modified_gmt":"2024-06-11T12:59:31","slug":"primer-tribunal-ambiental-acoge-reclamacion-construcciones-copiapo","status":"publish","type":"post","link":"https:\/\/1ta.cl\/1\/primer-tribunal-ambiental-acoge-reclamacion-construcciones-copiapo\/","title":{"rendered":"Primer Tribunal Ambiental acoge reclamaci\u00f3n de Construcciones Copiap\u00f3 y se anula el rechazo a las medidas para mitigar ruidos molestos"},"content":{"rendered":"<div id=\"attachment_24364\" style=\"width: 1280px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" aria-describedby=\"caption-attachment-24364\" loading=\"lazy\" class=\"wp-image-24364 size-full\" src=\"https:\/\/ukr.ivk.mybluehost.me\/website_11c5fef7\/wp-content\/uploads\/construccionescopiapo.jpg\" alt=\"\" width=\"1270\" height=\"588\" \/><p id=\"caption-attachment-24364\" class=\"wp-caption-text\">Se ordena a la Superintendencia del Medio Ambiente que se vuelva a evaluar el Programa de Cumplimiento (PdC) presentado por la empresa.<\/p><\/div>\n<p>&nbsp;<\/p>\n<p>Con dos votos a favor y uno en contra, el Primer Tribunal Ambiental acogi\u00f3 la reclamaci\u00f3n de Construcciones Copiap\u00f3 y dej\u00f3 sin efecto el rechazo al Programa de Cumplimiento (PdC) presentado por la empresa debido a ruidos molestos.<\/p>\n<p>A trav\u00e9s del fallo, el tribunal orden\u00f3 a la Superintendencia del Medio Ambiente (SMA) volver a evaluar el PdC y brindarle a la empresa \u201cla debida asistencia\u201d.<\/p>\n<p>El ministro redactor Marcelo Hern\u00e1ndez Rojas explic\u00f3 que \u201ca criterio del tribunal el deber de asistencia al regulado corresponde a un instrumento que debe ser ejercido por la SMA al momento de desplegar sus potestades de fiscalizaci\u00f3n y de sanci\u00f3n\u201d.<\/p>\n<p>El ministro explic\u00f3 que \u201ccuando la empresa present\u00f3 el PdC el organismo fiscalizador no formul\u00f3 observaci\u00f3n alguna sobre su contenido de fondo y solo requiri\u00f3 que se acreditara de manera adicional, la personer\u00eda del representante legal de la empresa\u201d.<\/p>\n<p>Otro punto que se destaca en la sentencia es que se constat\u00f3 que Constructora Copiap\u00f3 demostr\u00f3 un actuar orientado al cumplimiento de la normativa ambiental. \u201cLa reclamante ha implementado medidas materiales que han buscado mitigar los efectos de la faena constructiva\u201d, establece el fallo.<\/p>\n<p>Tambi\u00e9n se fundamenta la importancia que tiene que la SMA tenga un rol activo en la promoci\u00f3n de los PdC y fomente la colaboraci\u00f3n en pos de una protecci\u00f3n al medioambiente m\u00e1s efectiva y un mayor resguardo a la salud de la poblaci\u00f3n.<\/p>\n<p><strong>Voto en contra<\/strong><\/p>\n<p>La sentencia fue acordada con el voto en contra de la ministra presidenta Sandra \u00c1lvarez, quien estuvo por rechazar la reclamaci\u00f3n, en atenci\u00f3n a que el actuar de la SMA fue racional y proporcional, no vislumbr\u00e1ndose infracci\u00f3n al deber de asistencia al regulado. Precisa, entre otras consideraciones, que \u201cen el caso en estudio el reclamante nunca impetr\u00f3 este deber de asistencia -l\u00e9ase solicitud de una reuni\u00f3n con la SMA previo a presentar su PdC-, lo que significa que renunci\u00f3 a un derecho que ten\u00eda pero que no ejerci\u00f3\u201d.<\/p>\n<p><strong>Reclamaci\u00f3n<\/strong><\/p>\n<p>La reclamaci\u00f3n fue ingresada por la empresa constructora en contra de la Superintendencia del Medio Ambiente luego del rechazo del PdC por parte del organismo fiscalizador.<\/p>\n<p>El programa de cumplimiento fue presentado luego del incumplimiento a la norma de ruido en las obras de construcci\u00f3n del edificio \u201cLomas de Borgo\u00f1o\u201d.<\/p>\n<p><a href=\"https:\/\/www.portaljudicial1ta.cl\/sgc-web\/ver-causa.html?rol=R-96-2023\"><strong>Causa R-96-2023<\/strong><\/a><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Con una charla magistral y con la cuenta del trabajo 2023, el Primer Tribunal Ambiental dio inicio al A\u00f1o Judicial 2024.<\/p>\n","protected":false},"author":1,"featured_media":24364,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"nf_dc_page":"","_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[60,92],"tags":[],"class_list":["post-24363","post","type-post","status-publish","format-standard","has-post-thumbnail","category-noticias-del-primer-tribunal-ambiental","category-noticias"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.8 -
