Regional Antofagasta en contra de las Resoluciones Exentas N\u00ba0026\/2018 de 5 febrero de 2018 y N\u00baQ089\/2018 de 10 de mayo de 2018, ambas de la Comisi\u00f3n de Evaluaci\u00f3n Ambiental de la Regi\u00f3n de Antofagasta que resolvieron respectivamente, rechazar la solicitud de invalidaci\u00f3n del art. 53 de la ley 19.880 sobre Bases de los Procedimientos Administrativos por motivos de extemporaneidad.<\/p>\n<p>As\u00ed como tambi\u00e9n respecto de la Resoluci\u00f3n Exenta N\u00ba0852 \/2018 de 11 de julio de 2018, del Director Ejecutivo del Servicio de Evaluaci\u00f3n Ambiental, que rechaz\u00f3 el recurso jer\u00e1rquico, por improcedente decidiendo en su lugar que se constate o declare la nulidad de derecho p\u00fablico o que esta debe ser perseguida de oficio por la Comisi\u00f3n de Evaluaci\u00f3n Ambiental de la Regi\u00f3n de Antofagasta, o lo que a derecho corresponda respecto de las RCA N\u00ba 290\/2012 sobre &#8220;Actualizaci\u00f3n del proyecto Sierra Gorda&#8221;, presentada al Sistema de Evaluaci\u00f3n de Impacto Ambiental, SEIA el 2 de abril de 2012 y aprobada el 4 de diciembre de 2012.<\/p>\n<p>La RCA N\u00ba 186\/2 012 sobre &#8220;Transporte ferroviario de concentrado de cobre presentado por Antofagasta Railway Company PLC, el 25 de abril de 2012 y aprobada el 20 de agosto de 2012 y la RCA N\u00ba 177 \/2012 sobre &#8220;Recepci\u00f3n, acopio y embarque de concentrados de cobre presentada por ATI S.A. el 13 de diciembre de 2011 y aprobada el 6 de agosto de 2012.<\/p>\n<p>Por tanto, el Primer Tribunal Ambiental determin\u00f3 que \u201cConforme lo dispuesto por el art\u00edculo 27 de la Ley N\u00b020.600, habiendo sido la reclamaci\u00f3n interpuesta en tiempo y forma, adm\u00edtase a tramitaci\u00f3n e Informe el reclamado sobre la materia requerida dentro del plazo de 10 d\u00edas, adjuntando copia f\u00edsica autentificada del expediente administrativo que dio lugar a la reclamaci\u00f3n, en la forma que dispone el art\u00edculo 29 de la Ley de Tribunales Ambientales\u201d<\/p>\n<p>En relaci\u00f3n a la solicitud de dar curso a una orden de no innovar que pide la suspensi\u00f3n de la operaci\u00f3n de los edificios de recepci\u00f3n, acopio y embarque de concentrado de cobre, debido a loa efectos da\u00f1inos y al impacto irreversible en los afectados de la comuna de Antofagasta, el Tribunal determin\u00f3 \u201cautos para resolver\u201d que significa que estudiar\u00e1 la solicitud en virtud de los antecedentes.<\/p>\n<p>M\u00e1s detalles sobre esta causa se pueden encontrar ingresando a la <a href=\"https:\/\/causas.1ta.cl\/causes\/32\/expedient\/787\/?attachmentId=1291\">causas, causa rol R-13- 2018<\/a><\/p>\n[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]\n","protected":false},"excerpt":{"rendered":"<p>[et_pb_section fb_built=&quot;1&quot; admin_label=&quot;section&quot; _builder_version=&quot;3.22&quot;][et_pb_row admin_label=&quot;row&quot; _builder_version=&quot;3.25&quot; background_size=&quot;initial&quot; background_position=&quot;top_left&quot; background_repeat=&quot;repeat&quot;][et_pb_column type=&quot;4_4&quot; _builder_version=&quot;3.25&quot; custom_padding=&quot;|||&quot; custom_padding__hover=&quot;|||&quot;][et_pb_image src=&quot;https:\/\/ukr.ivk.mybluehost.me\/website_11c5fef7\/wp-content\/uploads\/sala-deaudiencia-1ta-2-1024&#215;352.jpg&quot; _builder_version=&quot;4.3.2&quot; force_fullwidth=&quot;on&quot; hover_enabled=&quot;0&quot;][\/et_pb_image][et_pb_text admin_label=&quot;Text&quot; _builder_version=&quot;4.3.2&quot; background_size=&quot;initial&quot; background_position=&quot;top_left&quot; background_repeat=&quot;repeat&quot; hover_enabled=&quot;0&quot;] Medida fue interpuesta en contra del SEA&#8230;<\/p>\n","protected":false},"author":1,"featured_media":2737,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"nf_dc_page":"","_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[60],"tags":[61],"class_list":["post-2724","post","type-post","status-publish","format-standard","has-post-thumbnail","category-noticias-del-primer-tribunal-ambiental","tag-antofagasta"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.8 -
