R-12-2018, caratulada \u201cJay Inversiones SpA con Superintendencia del Medio Ambiente\u201d, resolviendo por unanimidad de los ministros integrantes, se\u00f1ores Mauricio Oviedo Guti\u00e9rrez, Marcelo Hern\u00e1ndez Rojas y Cristi\u00e1n Delpiano Lira, rechazar la reclamaci\u00f3n interpuesta.<\/p>\n<p><strong>Antecedentes de la Causa<\/strong><\/p>\n<p>La citada causa inicia el 13 de agosto de 2018, con la reclamaci\u00f3n en contra de la resoluci\u00f3n exenta N\u00b0554 de fecha 14 de mayo de 2018 de la SMA, en la cual se solicit\u00f3 al Tribunal que la multa interpuesta al reclamante, fuese reemplazada por una amonestaci\u00f3n escrita, o bien, reducida a una sanci\u00f3n de 1 a 2 UTA o sustancialmente menor a la aplicada.<\/p>\n<p>Cabe recordar, que la resoluci\u00f3n mencionada fue dictada en el marco del procedimiento sancionatorio instruido con motivo de una denuncia efectuada por el se\u00f1or Benito G\u00f3mez Silva, en contra de dos fuentes emisoras contiguas
